Abetment of a thing ( section 107 IPC )

A person abets the doing of a thing , who – First :- Instigates any person to do that thing or, Secondly :- Engages with one or more other person or persons in any conspiracy for the doing of the thing , if an act or illegal omission takes place in pursuance of that conspiracy , and in order to the doing of that things , or Third :- Intentionally aids , by any act or illegal omission , the doing of that thing .

Instigation :- Wilful misrepresentation or wilful concealment of materiel fact by person and voluntarily causing or procuring or attempting to cause or procure a thing to be done is instigation .

Abetment of suicide

Accused will not said to have acted for abetment of suicide by deceased if nothing to show the nature and time of threat advanced because whatever is done to facilitate the commission of suicide should have proximity to the act .

Classification of offence

Punishment – Death,or imprisonment for life , or imprisonment for 10 years and fine . Cognizable – Non -bailable , Triable by Court of Session – Non -compoundable .

Abetment of suicide ( Section 306 IPC )

If any person commits suicide , whoever abets the commission of such suicide , shall be punished imprisonment of either description for a term which may extend to ten years , and shall also be liable to fine .
